Introduction & Platform Notice

This online store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our Products and Services to you. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

I. Definitions

  • Customer (You) – Any individual (Consumer), legal entity, or organizational unit without legal personality that places an Order through the Store.

  • Seller – HUSSAR GROUP, Malborska 1, 14-202 Iława, Poland, Tax ID (NIP): PL7441677385, email: comms@nightfighter.pro, acting as the operator of the store www.nightfighter.pro.

  • Consumer – A natural person executing a legal transaction with an entrepreneur which is not directly related to their business or professional activity (in accordance with EU Consumer Rights directives).

  • Sole Trader with Consumer Status (PNPK) – A natural person concluding a contract directly related to their business activity, when the content of this contract shows that it does not have a professional character for them.

  • Store – The online store platform operating at www.nightfighter.pro (including all subdomains).

  • Products (Goods) – All physical items and digital options presented for sale within the Store.

  • Order – The Customer’s declaration of intent made via the online checkout checkout funnel, directly leading to the conclusion of a Sales Contract.

II. General Provisions & Technical Requirements

  1. These Terms of Service define the rules, terms, and conditions for utilizing the Store, registering an account, and executing Sales Contracts.

  2. The Store is operated in full compliance with the laws of the Republic of Poland and European Union consumer directives.

  3. To use the Store and successfully complete an Order through our Shopify system, your device must meet the following minimum technical requirements:

    • An active internet connection;

    • An up-to-date web browser (e.g., Google Chrome, Mozilla Firefox, Apple Safari, Microsoft Edge, or Opera) with JavaScript and Cookies enabled.

  4. The Seller reserves the right to restrict the sale of Products or access to the Store to persons who are at least 18 years of age. By using this Store, you represent that you are at least the age of majority in your state or province of residence.

  5. The current version of these Terms is always accessible free of charge in the footer of the www.nightfighter.pro website and can be downloaded or printed at any time.

III. Use of the Store & Prohibited Actions

  1. An Order can be placed either as a registered member (Account holder) or as a guest.

  2. During registration or checkout, the Customer must provide accurate, current, and true personal data. Providing false, misleading, or third-party data is strictly prohibited and may result in the immediate suspension or termination of the account by the Seller.

  3. In accordance with Shopify's security architecture, the Store uses technical and organizational measures (including SSL encryption) to prevent unauthorized interception or modification of personal data sent over the Internet.

  4. You are strictly prohibited from using the site or its content:

    • For any unlawful purpose or to transmit any material that violates applicable local, national, or international laws;

    • To submit false or misleading information;

    • To upload or transmit viruses, malware, or any other type of malicious code;

    • To send unsolicited commercial communications or spam.

IV. Order Placement and Formation of Contract

  1. All product descriptions, technical parameters, and prices displayed in the Store constitute an invitation to treat (invitation to conclude a contract) and do not yet form a binding offer by the Seller.

  2. To purchase a Product, the Customer must add chosen items to the digital cart, proceed to the Shopify checkout page, fill out the required shipping/billing information, select a shipping method, and select a payment gateway.

  3. Up until the final confirmation button (e.g., "Pay Now", "Complete Order", or equivalent wording indicating an obligation to pay) is clicked, the Customer can modify any items in their cart or change their inputted data.

  4. Clicking the final payment/order button constitutes a binding offer by the Customer to conclude a Sales Contract with the Seller.

  5. Upon receiving the Order, the Shopify system will automatically send an email titled "Order Confirmation" summarizing all essential details of the transaction. The Sales Contract is formally concluded the moment the Customer receives this Order Confirmation email.

V. Shipping, Customs, and International Delivery

  1. Delivery of physical Goods is available within the territory of the European Union (EU) to the address provided by the Customer during checkout.

  2. Standard fulfillment and delivery times range from 1 to 14 business days from the day the Sales Contract is concluded, unless a different delivery period is explicitly stated on the specific product page.

  3. Cross-Border Compliance Notice: All items offered by the Seller are entirely legal to purchase, ship, and own under the laws of the Republic of Poland. The absolute responsibility for checking local legal compliance, import restrictions, or specific permit requirements regarding the purchase and ownership of the ordered Goods at the destination country (outside of Poland) rests solely upon the Customer. The Seller shall not be held liable for any legal hindrances, customs seizures, or local law violations resulting from the delivery of the Goods to the destination address specified by the Customer.

VI. Pricing and Methods of Payment

  1. Prices for Products in the Store are displayed in Polish Zloty (PLN) and/or Euros (EUR). Prices are inclusive of VAT (where applicable) and standard duties. Shipping fees are calculated and clearly shown separately during the checkout process before the final purchase is made.

  2. Available payment methods are processed securely via external certified payment gateways integrated into our Shopify platform (including credit/debit cards, electronic wire transfers, or digital wallets, depending on what is available at checkout).

  3. Unless otherwise explicitly stated, promotional codes or store discounts apply only to the base price of the Product and do not cover shipping fees, processing fees, or payment gateway surcharges.

VII. Right of Withdrawal (Returns & Cancellations)

  1. 14-Day Return Window: If you are a Consumer or a Sole Trader with Consumer Status (PNPK) residing within the EU, you have the legal right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you (or a designated third party other than the carrier) take physical possession of the Goods.

  2. To exercise your right of withdrawal, you must inform us via an unequivocal statement sent by email to comms@nightfighter.pro or by physical mail to our registered address. You may use the standard EU model withdrawal form, but it is not mandatory.

  3. Inventory Disclaimer: In the rare event that a Product ordered by the Customer becomes entirely unavailable or out of stock before fulfillment, the Seller reserves the right to cancel the Order and rescind the contract. In such cases, the Customer will be notified immediately, and any payments made will be refunded in full.

  4. Exceptions to Right of Withdrawal: You cannot exercise the right to return Goods if:

    • The Goods were custom-made, modified, or personalized according to the Customer's explicit specifications;

    • The Goods are delivered in a sealed package and cannot be returned due to health protection or hygiene reasons, provided the seal was broken after delivery.

  5. Effects of Withdrawal:

    • We will reimburse all payments received from you, including the costs of the cheapest standard delivery offered by us, no later than 14 days from the day we are informed of your decision to withdraw.

    • We will perform the refund using the same payment method you used for the original transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of such reimbursement.

    • We may withhold the refund until we have received the Goods back or until you have supplied sufficient proof of having sent back the Goods, whichever is earliest.

    • You must bear the direct cost of returning the Goods. You are only liable for any diminished value of the Goods resulting from handling them beyond what was necessary to establish their nature, characteristics, and proper functioning.

VIII. Warranty Claims (Product Non-Conformity with Contract)

  1. The Seller is under a legal duty to supply Goods that conform with the Sales Contract. For Consumers and Sole Traders with Consumer Status (PNPK), the Seller's liability for any lack of conformity is governed by Chapter 5a of the Polish Act on Consumer Rights (implementing EU Directive 2019/771).

  2. If the Product does not conform to the contract, you have the right to request:

    • Repair of the Goods, or

    • Replacement of the Goods.

  3. The Seller may exchange the item when the Consumer demands a repair, or vice versa, if bringing the item into conformity in the manner chosen by the Consumer is impossible or would involve disproportionate costs for the Seller.

  4. The Consumer may submit a statement requesting a price reduction or termination of the contract (refund) only if:

    • The Seller has refused to repair or replace the item;

    • The Seller has failed to bring the Goods into conformity;

    • The lack of conformity appears despite the Seller's attempt to repair or replace it;

    • The lack of conformity is substantial enough to justify an immediate price reduction or termination.

  5. All warranty claims must be submitted electronically to info@hussargroup.pl or sent to the Seller's registered physical address.

  6. The Seller will respond to the Consumer's claim within 14 calendar days of receipt.

  7. The Seller bears all costs associated with repairing or replacing non-conforming Goods, including collection and shipping costs.

  8. B2B Exception: For Customers who are purchasing as business entities (not acting as Consumers or PNPK), any statutory warranties, implied warranties, and liabilities under the civil code (rękojmia) are entirely excluded to the maximum extent permitted by law.

IX. Digital Services & Electronic Claims

  1. The Seller provides digital services related to the operation of the platform (e.g., maintaining User Accounts, handling the Shopping Cart, newsletter delivery). Liability for these services is governed by Chapter 5b of the Polish Act on Consumer Rights (implementing EU Directive 2019/772).

  2. Any technical issues, bugs, or service disruptions regarding the functionality of the Store can be reported to comms@nightfighter.pro.

  3. The Seller will review technical complaints and issue a response within 14 calendar days.

  4. The Seller reserves the right to implement temporary technical breaks for platform maintenance, security updates, or system upgrades.

X. Dispute Resolution & Final Provisions

  1. If a dispute arises between the Seller and a Consumer that cannot be resolved via direct dialogue, the Consumer has the right to use out-of-court complaint and redress mechanisms.

  2. European Consumers may submit complaints via the official EU Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr

  3. Any disputes arising between the Seller and a Consumer shall be settled by the courts of competent jurisdiction determined by applicable statutory law.

  4. Any disputes arising between the Seller and a business Customer (B2B) shall be submitted exclusively to the court having jurisdiction over the registered seat of the Seller (HUSSAR GROUP).

  5. If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms.

  6. These Terms of Service are effective as of 01.07.2026.
