VII. Right of Withdrawal (Returns & Cancellations)

14-Day Return Window: If you are a Consumer or a Sole Trader with Consumer Status (PNPK) residing within the EU, you have the legal right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you (or a designated third party other than the carrier) take physical possession of the Goods.

To exercise your right of withdrawal, you must inform us via an unequivocal statement sent throught the https://shopify.com/100083466566/account or by email to comms@nightfighter.pro or by physical mail to our registered address. You may use the standard EU model withdrawal form, but it is not mandatory.

Inventory Disclaimer: In the rare event that a Product ordered by the Customer becomes entirely unavailable or out of stock before fulfillment, the Seller reserves the right to cancel the Order and rescind the contract. In such cases, the Customer will be notified immediately, and any payments made will be refunded in full.

Exceptions to Right of Withdrawal: You cannot exercise the right to return Goods if:

The Goods were custom-made, modified, or personalized according to the Customer's explicit specifications;

The Goods are delivered in a sealed package and cannot be returned due to health protection or hygiene reasons, provided the seal was broken after delivery.

Effects of Withdrawal:

We will reimburse all payments received from you, including the costs of the cheapest standard delivery offered by us, no later than 14 days from the day we are informed of your decision to withdraw.

We will perform the refund using the same payment method you used for the original transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of such reimbursement.

We may withhold the refund until we have received the Goods back or until you have supplied sufficient proof of having sent back the Goods, whichever is earliest.

You must bear the direct cost of returning the Goods. You are only liable for any diminished value of the Goods resulting from handling them beyond what was necessary to establish their nature, characteristics, and proper functioning.

VIII. Warranty Claims (Product Non-Conformity with Contract)

The Seller is under a legal duty to supply Goods that conform with the Sales Contract. For Consumers and Sole Traders with Consumer Status (PNPK), the Seller's liability for any lack of conformity is governed by Chapter 5a of the Polish Act on Consumer Rights (implementing EU Directive 2019/771).

If the Product does not conform to the contract, you have the right to request:

Repair of the Goods, or
-
Replacement of the Goods.

The Seller may exchange the item when the Consumer demands a repair, or vice versa, if bringing the item into conformity in the manner chosen by the Consumer is impossible or would involve disproportionate costs for the Seller.

The Consumer may submit a statement requesting a price reduction or termination of the contract (refund) only if:

The Seller has refused to repair or replace the item;

The Seller has failed to bring the Goods into conformity;

The lack of conformity appears despite the Seller's attempt to repair or replace it;

The lack of conformity is substantial enough to justify an immediate price reduction or termination.

All warranty claims must be submitted electronically to comms@nightfighter.eu or sent to the Seller's registered physical address.

The Seller will respond to the Consumer's claim within 14 calendar days of receipt.

The Seller bears all costs associated with repairing or replacing non-conforming Goods, including collection and shipping costs.

B2B Exception: For Customers who are purchasing as business entities (not acting as Consumers or PNPK), any statutory warranties, implied warranties, and liabilities under the civil code (rękojmia) are entirely excluded to the maximum extent permitted by law.
IX. Digital Services & Electronic Claims

The Seller provides digital services related to the operation of the platform (e.g., maintaining User Accounts, handling the Shopping Cart, newsletter delivery). Liability for these services is governed by Chapter 5b of the Polish Act on Consumer Rights (implementing EU Directive 2019/772).

Any technical issues, bugs, or service disruptions regarding the functionality of the Store can be reported to comms@nightfighter.pro.

The Seller will review technical complaints and issue a response within 14 calendar days.

The Seller reserves the right to implement temporary technical breaks for platform maintenance, security updates, or system upgrades.
